Sacramento Opera: Building a Legacy
A Mutually Beneficial Planned Stewardship Program
When is the right time to consider making a planned gift?
It is always important to have a thoughtful, tailored plan for your estate and
for caring for your loved ones. But there are many life events which are
appropriate occasions for you to consider adjusting your plan, or to start your
estate planning if you haven’t already done so. Here are just a few examples:
Retirement: have you or your spouse recently retired?
Marriage: did you or your child recently wed?
Expecting a child? (Start planning before you have to start changing diapers!)
Business change: have you recently sold or acquired a business?
Asset disposition: is it time to transfer an asset (for example, real property
or stock) which has substantially appreciated in value?
On the move: if you’ve recently moved to a new State, you may need to adjust
your plan.
Significant income item: do you face a large tax bill this year due to a taxable
income event?
Inheritance: did you receive a bequest or substantial gift?
Tax law change: has Congress made a change in the tax code that impacts your
situation?
Parting ways: did you or a child recently go through a divorce?
Serious illness in the family.
The loss of a loved one.
Or, has it simply been a long time since you last addressed your estate
plan? It may be a good time to think about how your estate is held, and who will
benefit from your assets.

So, what is out there? There are several options. One or more of these examples
may fit in your estate plan.
Charitable Trusts. A trust is an instrument that allows you to control
and direct property while it is held by another person, a trustee, for the
benefit of your chosen beneficiaries. Two types of trusts enable you to control
your property, even though you have committed it for some charitable purpose and
thus obtain an immediate tax benefit.
The first type is a charitable remainder trust, where you can place assets in
trust now, continue to derive income from those assets, and dedicate the trusted
assets to a charitable organization upon your and/or your spouse’s death. You
may be able to obtain substantial tax savings now, and continue to derive income
into the future, using a charitable trust.
Or, you can establish a charitable lead trust to hold assets for a period of
time, and direct income from the assets to be passed to a charitable
organization, and upon some specified future event the property will return to
your estate.
Charitable Gift Annuities. This is a more simple variation of the gift
that keeps on giving -- not just to your favorite charity, but to you! You may
donate an asset, in exchange for the charity’s promise to make an annual payment
-- an annuity -- to you for a specified time. You are allowed to deduct the net
gift now.
Donor Advised Funds. With a donor advised fund, your contributions are
invested by the charity in a choice of investment pools which you can recommend.
Pooled Income Funds. In this type of fund, your contributions may grow
tax-free, while your beneficiaries receive a variable income stream for their
lives.
Remainder Interest in a Residence. Many donors have decided they will
donate their homes, or some rental property, to their favorite charity upon
their death. By donating a remainder interest in a residence, you can accomplish
this, but you receive the tax benefit of the donation right away. When you
donate a remainder interest, you keep and continue to own the property for the
rest of your life.
